DMCA Policy
Effective August 25, 2026 · Version 1.1
Vested Gifts ("Vested") respects intellectual property rights and expects users to do the same. This policy explains how to report copyright infringement and how Vested handles repeat infringers, consistent with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.
1. Designated DMCA Agent
We have designated the following agent to receive notifications of claimed copyright infringement:
DMCA Agent — Vested Gifts [REGISTERED AGENT NAME] [REGISTERED AGENT ADDRESS] Phoenix, AZ [ZIP] Email: support@vestedgifts.com Phone: [PHONE]
Our designated agent is registered with the U.S. Copyright Office at dmca.copyright.gov.
2. How to Submit a Notice of Claimed Infringement
If you believe content on the Services infringes your copyright, send our DMCA Agent a written notice that includes all of the following (required by 17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of the copyright owner or person authorized to act on the owner's behalf;
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list);
- Identification of the material that is claimed to be infringing and information sufficient to allow us to locate it (e.g., the URL of the Book page);
- Your contact information (address, telephone, email);
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
Notices that do not substantially comply with these requirements may not be effective. Misrepresentations in a DMCA notice may subject you to liability for damages under 17 U.S.C. § 512(f).
3. Counter-Notice
If you believe content you posted was removed or disabled by mistake or misidentification, you may submit a counter-notice to our DMCA Agent containing:
- Your physical or electronic signature;
- Identification of the material that was removed and its location before removal;
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, and telephone number;
- A statement that you consent to the jurisdiction of the U.S. District Court for the district where you reside (or, if outside the U.S., for the District of Delaware) and that you will accept service of process from the person who provided the original notice or that person's agent.
Upon receipt of a valid counter-notice, we may restore the removed content within 10–14 business days unless the original complainant files an action seeking a court order against you.
4. Repeat Infringer Policy
Vested will, in appropriate circumstances and at its sole discretion, terminate the accounts of users who are repeat infringers of copyright. Vested may also limit access to the Services or terminate accounts for other intellectual property violations.
5. Trademark and Other IP Claims
For trademark, right-of-publicity, or other non-copyright intellectual property claims, send a detailed written notice to support@vestedgifts.com identifying the claim, the work or mark, and the location of the alleged infringement.
6. Modifications
We may update this policy. The "Effective Date" reflects the current version. Significant changes will be announced on the Services.
